The following terms and conditions govern the usage of the Cosmos mobile application and all the information, services, content, and products available in the application. These terms and conditions provide detailed information on the usage of our services. Please read the document carefully.

1. Definitions

In the Terms and Conditions, unless the context otherwise demands or permits,

Company (also referred to as “We”, “Us”, and “Our”) here refers to Cosmos, ___________________

You or Your in this document refers to the individual who is accessing or using the application and its services.

Account refers to the unique user account created by you to access our services, website, or parts.

Services refer to the programs and other modules offered by the company for/not for sale on the application.

Application refers to Cosmos, accessed at ____________.

User Credentials mean user name, password, PIN, security code, or other details used alone or in combination to verify a person’s identity and authorize him or her to access and use the Cosmos website.

User Data shall refer to all the data relating to the business, services, or other data provided by the user to enable us to provide services bound by the Terms and Conditions listed in the document.

Effective Date means the date of execution of the service and the terms agreed upon by the user and the company.

2. Accepting the terms

By accessing or using any part of Cosmos, you agree that you are entering a legal agreement that is bound by Cosmos. You agree that the terms and conditions and privacy policy govern your usage and access to our services.

The terms and conditions are made by and between the party (“User”) on whose behalf they are accepted and Cosmos and are effective as of the date they are accepted by the user. The document is an electronic record and does not require physical or digital signatures. By rendering your electronic acceptance to the usage of services, you acknowledge your agreement to the terms of service and conclude a legally binding agreement with Cosmos, address.

Your usage or access to the services offered by Cosmos is conditioned by your agreement to comply with this agreement. By accessing and/or using our application, you acknowledge that you have read and understood the agreements and agree to be legally bound by our terms and conditions and our Privacy Policy. If you do not agree to the terms of services listed in this document, please refrain from using our application and our service.

3. Modifications to the terms

We reserve all rights to change, amend, modify, or revise the terms from time to time, as and when the need may arise. We may add/change the terms when we add new programs, and courses or modify the app features.

Cosmos reserves the right to make such changes with/without any prior notice. When we do so, we revise the date given at the top of this document to reflect the latest. It is your sole responsibility to review the terms and conditions periodically and stay aware of the changes, amendments, or revisions to our terms and policies.

The revised, modified, or changed terms and conditions come into effect as and when they are updated and posted. Your continued usage of the application and the services offered on and after updates, revisions, and modifications constitutes your acceptance of the revised terms and conditions. If you do not agree to the updated terms, please refrain from using our application and services, and delete the same from your device.

4. Service

COSMOS is a mobile application designed to provide users with audio and text-based content focused on life coaching and manifestation practices.
Certain practices within the application may necessitate the uploading of images, videos, or text-based content.
Selected videos, audio clips, or text content can be shared via the app through third-party services, including but not limited to social media, YouTube, or website embeds.
For access to advanced features, specialized programs, and specific practices, users may be required to make payments as part of a subscription. The details about such services are comprehensively outlined in the 'Purchases' section.

5. Account Requirements

Registration

Users of the Cosmos application may be required to create an individual account with the company to be able to access the entire range of benefits offered by the application. One person is allowed to create only one account and the user is responsible for maintaining the safety and security of the account.

You are not authorized to create an account on someone’s behalf. If an impersonation or misconduct is brought to our notice, Cosmos will remove the account and delete all the information about that account. You may not use a name or a trademark that is bound within the rights of another person, or a name that is vulgar and obscene. We reserve all rights to terminate the account under a suspected violation and investigate further the breach of the terms and conditions agreed upon by the user.

Given that the app allows users to create an account through third-party profiles or accounts like Google, Facebook, etc., you agree that you are subject to be bound by the terms and conditions of the third-party service provider. Kindly note that the privacy policy and terms of such third-party service providers may be different from those of the Cosmos application.

Information and data

You can create an account on our application using your email address. You have to choose a password to protect your account. You can also sign in with your Apple id. If you do so, we will create your account using the details provided by your Apple account. We expect that you provide us with accurate information to be able to serve you better. Failing to provide the right details is a breach and may result in the termination of your account.

You also agree that you would not disclose your account credentials to anyone else. It is the user’s responsibility to maintain the confidentiality of their credentials. You are solely responsible for all the activity that happens through and on your account, whether or not you know about them. It is your responsibility to notify us if you come across unauthorized access to your account.

Service Eligibility

You must be eligible to undertake a legally binding contract to be able to use the Cosmos services. If you are less than 18 years of age, your parent or guardian may provide consent to the terms of the agreement. The guardian or the parent will be responsible for the minor’s use and access to services on the application. If someone who is under 18 years of age tries to access our application and is brought under the notice of Cosmos, we will deactivate or remove the account relevant to the user and delete all the information related to the same.

Cosmos reserves all right to refuse to offer access to the app or any services that are offered through the app to a person or an entity. The eligibility criteria are subject to its discretion and may change anytime. Please read the document thoroughly before you acknowledge it.

6. Purchase

By choosing to purchase our services, you agree that you are bound by a legal contract. When you make purchases you may be prompted to provide information including but not limited to the following- Your name, email address, phone number, billing address, shipping information, credit or debit card number, the expiration date for your card, and so on.

As you provide the information, you also warrant that 1. The information provided by you is true and accurate to your knowledge. 2. You hold the legal right to use the credit card or debit card in connection to your order. 3. You grant us the right to transfer the information to the third-party service provider to complete the transfer of payment and purchase.

Cancellation and refunds

Your decision to purchase our services indicates your commitment to participate in the process and follow through to its conclusion. All purchases are final and non-refundable. The fees associated with your purchases will appear on your account summaries through the identifier ‘Cosmos’. We will not provide refunds for any program unless it is proven that you are not able to access our agreed-upon services due to a technical glitch.

We reserve the right to cancel or refuse your purchase or order at any time due to the reasons listed below, but not limited to, service availability, error in the service description, error in your order, fraudulent activity, or when an unauthorized transaction is suspected.

The services, practices, and coaching programs offered by Cosmos shall be purchased through the mobile application only. We expect you to read through the offerings of our service thoroughly and introspect your decision before you make a purchase. In case you are not able to make an appropriate decision on the choice of the service, we recommend a professional assessment or an online consultation before purchasing the service. We recommend that you take a copy of the transaction details and receipts acknowledging your payment for record-keeping.

In the case of subscription-based purchases, the date of issuance of login credentials after the purchase is deemed to be the starting date of access to services. You may not be able to access the course after the expiry of your subscription. The access shall be denied without any notification or intimation. Some courses offer a trial period.

If you fail to access the service because you fail to meet the technical requirements prescribed in the service module and are notified before your purchase, Cosmos will not take any responsibility. You warrant that you are ineligible to claim a refund under such circumstances. It is your responsibility to read the technical requirements carefully before you make a purchase.

7. Pricing and Subscription

COSMOS retains the authority to alter or adjust the pricing and fees associated with its service offerings. Subscription details can be found within our mobile application, and they will be presented based on your residing country and the applicable currency in that region. We strongly advise reviewing the available plans thoroughly before finalizing any purchase decision.

Our payment methods are adaptable, aligning with the options provided by Google Play Store for Android or the IOS platform for Apple devices. You can utilize Go Opt for Apple In-app payments, Google Play In-app payments, or choose from other payment modes specified by the respective platform/payment gateway to complete your purchase. By proceeding with a transaction, you affirm that you possess the legal authority to use the provided payment method.

The company maintains the right to revise prices at any time, up until the acceptance of a purchase order. Prices may fluctuate based on foreign exchange rates, and it is solely the user's responsibility to confirm service specifications, pricing, and availability before committing to a purchase.

The total amount payable for a transaction involving the acquisition of service access will be displayed before you proceed to place or confirm the order.

Subscription-based services

Our subscription-based services are structured with monthly or annual billing cycles, and it's crucial to note that we do not offer a free trial option. However, users are granted unrestricted access to our free content without the need for a subscription, allowing for an unlimited exploration period.

Premium content becomes accessible exclusively through subscription, and users can seamlessly transition to enjoying these enhanced features upon subscribing. It's essential to emphasize that both the subscription and payment processes strictly adhere to the policies set forth by the Google Play Store for Android and the App Store for IOS.

The subscription fee is billed in advance, and once initiated, it remains non-refundable. No refunds, credits, or extensions will be provided for partial use of services during the subscription period. Additionally, no reimbursements will be issued for unused days or months on a monthly or annual subscription account.

For users opting for our monthly or yearly subscription services, charges will occur on a recurring cycle. Exiting the subscription at any time is an available option, with the subscription remaining valid for the initially subscribed period. Following cancellation, no further charges will be incurred in the subsequent subscription cycle.

With current premium subscription:

Free Access: Grants limited access to a selection of affirmation audio.

Upgrading to Premium: Unlocks unrestricted access to all affirmation audio.

Premium Memberships: Automatically renew monthly or yearly until canceled.

In the case of upgrading or downgrading your subscription, adjustments will be prorated in line with the policies specified by the respective platform. We appreciate your understanding and compliance with these terms and conditions as they contribute to a seamless and transparent user experience.

Third-party Transaction Services

Cosmos integrates with third-party services and integrations to facilitate the transfer of payment for the use of our services. You authorize us to provide the information for the seamless completion of the transaction and agree to pay the applicable fees and taxes. Cosmos may charge your third-party processing account, including, but not limited to the Google Play Store or Apple App Store. You agree to bear the additional charges, taxes, or fees that your bank, application provider, and other financial service providers may charge. On receipt of payment for your order, we shall issue an email authentication and your service purchase is binding on Cosmos only after being confirmed and accepted by us. All payments are non-refundable and non-transferable unless it is provided explicitly in the terms.

Cosmos reserves the right to cancel your purchase if we suspect mishandling or fraudulent activities through your account, or under other circumstances that the company deems inappropriate in its sole discretion.

8. Copyrights

License Agreement

Cosmos offers you a non-transferable, revocable, limited-period license to access/use our services. You agree to use the app and its services on a device or gadget that is under your control. The usage is governed by the instructions laid down by the Play Store, marketplace place, or the App Store from which you download the app. The license terms and agreement will also bind on the updates and upgrades provided by Cosmos, unless and otherwise, such updates/upgrades come with a separate, exclusive license.

However, your rights are limited in that you are prohibited from doing the following-

Attempting to modify, extract, or derive a service or a portion of it.
Downloading or extracting the service content or a portion of it using robots or data mining techniques.
Attempting to access the features or services that you are not authorized to access.
Undertaking any activity that would question the security and safety of our service offering
Accessing the service and attempting to build a competitive product
Using the service for purposes other than the intended ones including/ not including those mentioned in the Terms and Conditions
Attempting to damage or intrude into the functioning of the application, its services, or other parts.

The application and its content are protected by Indian and/or foreign copyright laws and belong to the company and its affiliated third parties. You may not download, reprint, or distribute the content in the application.

You agree to not do any of these and in case you fail to comply with the terms and conditions listed we will terminate the usage of your service. You are liable to prosecution if found guilty of copyright infringement and breach of other contracts.

9. Intellectual Property Rights and Trademarks.

The application, its features, service offerings, and the content remain an exclusive property of our company. The application is protected by the copyright, trademark, and other laws of India and other countries. Our trademarks may not be used elsewhere with/without attachment to another company, without prior approval and consent of Cosmos.

The logos, text, scripts, graphs, trademarks, designs, HTML, format, source and object code, format, queries, and other materials and content that are accessible from this application are the proprietary information of the company. This cannot be copied, distributed, uploaded, posted, or republished without written authorization and approval of the company. You are prohibited from using our logos or other trademarks without written consent from the company.

Cosmos provides the service to you as a user for personal use only. You agree to not engage in use, copying, or redistributing the content in full or in parts, other than those permitted explicitly in the document, including copying or distributing the content for commercial purposes.

10. Content

Content in the Terms and Conditions as well as in the Privacy Policy refers to images, videos, audio, and text materials that are offered as a part of our services through the application.

The application may be hyperlinked to third-party service providers that are not maintained by or related to the company. The inclusion of a hyperlink does not mean that the company endorses, sponsors, or promotes the service provided by the third party. The company will not endorse or take responsibility for the content that is inaccurate or inappropriate to your purpose. The user is responsible for shielding him or herself from such content. The company has neither the obligation to review the content of third parties nor is responsible for the content. Hyperlinks are to be accessed at the sole discretion of the user. The company does not warrant the content, accuracy, and intellectual property infringements of the hyperlinks that direct you to third-party service providers. We disclaim any responsibility to the harm or abuse that results from the use of such third-party content to the users of the Cosmos application. It is the sole responsibility of the user to read and acknowledge the terms and conditions of the third-party service provider linked to our application before you access them.

We put in humongous efforts to be creative and original. We also respect the intellectual property rights of other individuals and organizations. In case the content on the service or the application infringes your privacy or intellectual property rights and you are the owner of a copyright or authorized on behalf of one, and you notice that your copyrighted work has been copied or infringed on the application, or if you come across harmful, objectionable or unlawful content, please write to us admin@infinitecosmos.org, so we can take appropriate actions.

Some services offered through this application may require that you submit images, videos, text, or other form of content. By doing so, you grant the company a royalty-free, irrevocable, non-exclusive license to use, modify, translate, publish, distribute, and display any such content communicated to the company through the application. It is no responsibility of the company to treat such information with confidentiality and may use the same without incurring liable charges for royalties or similarities that may occur in the future. You warrant that you have the right to post the submission and that such content may not violate the law and privacy of another individual or an entity. The personal information that you share through the application is protected by the privacy policy attached to this application.

By using our services, you agree that you may not post, submit, or distribute information relevant directly or indirectly to our company that -

Is objectionable, vulgar, or obscene.
Violates any law or norms subject to the country of access, subscription, and usage.
Incites violence, promotes illegal activity, or motivates others to take up an illegal act.
Defames others, or intrudes into the privacy of someone else.
Misrepresents another person or manipulates the content provided in the app.
Invites funds, sponsors, or advertisers.
Exploits children and minors by exposing them to content that is inappropriate for their age.
Involves in the design or transmission of viruses, trojan horses, and other harmful programs that are designed with malicious intent to interrupt and destroy the functionality of the device, gadget, or application.

The above list is subject to change and updation from time to time and this is at the sole discretion of the company. The company may do so with or without prior notice. It is the responsibility of the user to check the content before using, distributing, or transmitting the content of this application in parts or in full.

11. Suspension/ Termination

If you violate any of the terms listed in the document, we may suspend or terminate your rights to access the application, the services, and/or its content with or without prior notice. Suspension or termination may restrict or ban your usage or access to the application in parts or full.

In case of such suspension or termination, Cosmos will not take any responsibility for the loss of content or access connected to the installation or usage of the application on your device. You agree that Cosmos is under no obligation to reactivate your access or get back the content to you under any circumstance or any reason.

If your rights to access and use our application and the services get terminated or suspended you agree to not use or attempt to access the application or any of the services thereon.

12. Installation and security

You may access the Cosmos app by downloading the application to your mobile device or other electronic gadget and pressing the icon that appears at the end of the download.

It is the responsibility of the user to not handle the installation of the application on your device as well as not allow others to use the installed version of the application. The user is solely responsible for any action that is performed through the device. It is the responsibility of the user to ensure that the device is stored and used from a secure location and the user shall accept all risks that accompany unauthorized usage and access of the application. The user is also expected to refrain from using somebody else’s installed version of the Cosmos app.

13. Notifications and communications

Once the application is downloaded, the app may request the user’s consent to push notifications to the user. We recommend that you allow such notifications for the app to work properly and for you to witness the fullest benefits of using the app.

We may send notifications on offers, promotions, and discounts, apart from service-related upgrades and updates. When you sign up for a service that requires the user to perform certain tasks, the application may add tasks to the calendar automatically. You are free to deactivate notifications or reactivate them at a later time by changing the notification settings on your device. However, we recommend that you allow such notifications to flow through so that you may achieve the purpose of your service purchase without any distractions.

By accessing and/or using our services you warrant that the company may send communications through the electronic medium and such communications should comply with the legal requirements. If you would like to withdraw from such communications, write to us at admin@infinitecosmos.org.

14. Disclaimer

The content, services, and information shared through the application by the company and other third-party service providers are provided to you on an “AS IS” or “AS AVAILABLE” basis without warranties of any kind. We disclaim all warranties, expressed or implied, oral or written, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, title, and non infringement. Neither the company nor the service providers warrant that the Cosmos application or its functionalities will be error-free or uninterrupted, that the defects will be rectified, or is free of viruses or other harmful components.

We disclaim and do not warrant any representations regarding the results of download, use, or access of the services of our application in terms of their correctness, timelines, precision, accuracy, or otherwise. Cosmos makes no representation that the application will be compatible with any other software, applications, or system features, or meet any performance expectations.

The application offers ideas, practices, and programs to navigate yourself to your goals and desires. By any means, this is not a substitute for professional mental health care, counseling, or medical care. Our practices are not intended to cure any medical conditions or mental health conditions. You are solely responsible for the mental and physical well-being during the sessions offered as part of the online services provided through the application, including the choices and decisions you make. The use and consumption of information and content provided through this application is solely at your risk.

Neither the company nor its stakeholders are financial advisors and do not consume anything provided through this application as a financial service. We are not into investment advisory and do not provide any financial investment consultation. The application and the services provided by Cosmos are purely intended for educational purposes and the information shared through the application is for general information purposes only. The services, content and information carried through them are tuned to the general audience and should not be considered as advice offered specifically to an individual.

15. Transfer of rights

You may not assign or transfer any rights or obligations laid down under the agreement to other people related or not related to you. Such an assignment will be considered ineffective. We may assign rights and obligations in full or in parts without notice to you. We may also substitute Cosmos for any third party that is in agreement to assume our rights and obligations laid here in this document.

By using our services, you also acknowledge that we are entitled to assign and transfer all their rights and obligations to another legal entity that may operate Cosmos and offer related services in the future.

16. Governing Law, dispute resolution and severability

The agreement is governed by the Information Technology Act, 2000, India. If any of the clauses, or provisions listed in the terms and conditions is deemed to be unlawful, illegal, or unenforceable, such provisions will be considered severable and other remaining provisions will continue to be valid and enforceable.

17. Indemnification

If a third party raises a claim against us or/and in connection with your breach of terms, including usage or distribution of content without authorization, with your breach of law or regulations, your content, your infringement of intellectual property rights, or other violation of rights of third parties, you agree to defend and indemnify the indemnified parties including but not limited to company, subsidiaries, directors, affiliates, content providers, employees, agents, and contractors. You agree to hold us against costs, damages, liabilities, awards, expenditures, and attorney’s fees arising out of a breach or unauthorized use. You agree to indemnify and protect the indemnified parties against damages and harms that result from the use of the content and information provided on the application.

You may have to comply with local laws and regulations beyond those that are presented and elaborated here in this document.
